SpankOdds User Agreement – New Jersey

Before utilizing the SpankOdds services, please familiarize yourself with this User Agreement. Your adherence to these terms is crucial for a mutually beneficial relationship.

SpankOdds, encompassing both its mobile and web platforms ("platform"), is a service presented by SpankOdds Enterprises, LLC ("Our Company").

1. Acknowledgment and Acceptance

By accessing or engaging with the SpankOdds platform, you confirm your complete understanding and unequivocal acceptance of these conditions. If you find yourself in disagreement with any of these terms, you are advised to cease all interactions with our services and uninstall any related applications. Continued usage of our services implies an understanding that any disagreements or disputes would be addressed via the stipulated arbitration process within this agreement.

2. Granted User Rights

SpankOdds Enterprises extends to its Users:

• A comprehensive access to diverse tools, resources, analytics, schedules, reports, and more ("Content").
• An exclusive authorization to utilize the platform, designed to facilitate the viewing and interpretation of the Content, exclusively on devices that the User legally possesses.

This section encapsulates the entire spectrum of rights and permissions granted to the user.

3. User Boundaries and Restrictions

As a responsible user of our platform, you are strictly prohibited from:

• Cloning, replicating, or unlawfully customizing any part of the platform.
• Engaging in unauthorized or unlawful extraction, scraping, or copying of Content.
• Decompiling, disassembling, or reverse-engineering the platform.
• Commercially distributing, leasing, or crafting derivative interpretations of our platform or its Content.
• Any actions, overt or covert, that might constitute a breach of this Agreement.

Your rights to the platform can be rescinded if you:

• Refrain from meeting financial obligations towards our services.
• Furnish our Company with a 5-day advance termination notice, accompanied by a complete removal of all traces of our platform from your possession.

Non-compliance with the stipulated terms will result in immediate cessation of all granted rights.

4. Platform Evolution & Modifications

SpankOdds Enterprises holds the unencumbered right to:

• Implement iterative updates, modifications, or changes to the platform.
• Replace, modify, or retract specific elements of the platform or its Content.
• Introduce newer versions or updates of Content.
• Amend accessibility parameters or limit access to certain features.

While we strive for consistency, we bear no liability for unforeseen alterations or service discontinuations.

5. Data Usage and User Privacy

Users acknowledge and permit our Company and its partners to amass and harness user data sourced from platform interactions. This data aids in refining our services, promoting relevant content, and crafting tailored user experiences.

6. Confidentiality Pact and Proprietary Rights

All Content, along with the unique architecture of the platform, is proprietary to SpankOdds Enterprises. Users are bound to protect this information, refraining from any unauthorized sharing, distribution, or leaking.

7. Legal Adherence and Compliance

Users are expected to:

• Retain and, if necessary, present required permissions, licenses, or credentials.
• Meticulously abide by all New Jersey statutes and regulations, especially those relevant to the platform's functions.
• Timely address and settle any and all tax obligations arising from the use of our services.

8. No Refunds

All sales and transactions pertaining to SpankOdds services are deemed final. We do not offer refunds once services have been accessed or utilized.

9. Warranty Disclaimer

Our offerings are provided AS-IS. While we commit to excellence, we cannot guarantee an error-free experience or uninterrupted service availability. Additionally, we do not guarantee the accuracy or completeness of the data provided on the platform. The data is for informational purposes only, and we are not responsible for any gambling activities that users partake in based on this data.

10. Liability Threshold

Claims against SpankOdds Enterprises shall never surpass the acquisition cost of the services procured by the user. We are not liable for consequential or indirect losses, damages, or unforeseen implications.

11. Settling Disagreements

All disagreements or disputes arising from this agreement shall be addressed via an arbitration process, as per New Jersey's arbitration laws. Users agree to abstain from pooling claims and to pursue resolutions on an individual basis.

12. Governing Regulations & Action Duration

This User Agreement is construed in line with New Jersey's legal norms. Invalid sections do not invalidate the entirety of this Agreement. Any claims or actions based on this agreement must be initiated within a year of the incident leading to the claim.
